HERALD GENERAL MANAGER MANJUNATH ACCUSED OF SEXUALLY HARASSING A WOMAN EMPLOYEE AT WORK

Something disturbing has come up guys.
A woman employee at the Herald Cable Network (HCN), Panjim has filed a sexual harassment complaint against Herald general manager N Manjunath.
This is not the first instance, when a high-ranking Herald employee has been charged with sexual harassment. We had mentioned a case in an earlier PP post, but had stopped short of taking names because we didn’t have any evidence to substantiate our claims.
This time round, we have seen a copy of the complaint written by the victim, which has been submitted to the Herald. The copy has been marked to Herald MD Raul Fernandes, HCN Editor Nisser Dias and the National Commission for Women.
We are withholding the name of the complainant, but if any media organisation wishes to pursue the story, a copy of the complaint can be picked up from the NCW office.
The guy who’s grinning in the photograph above is N Manjunath, who’s been accused of sexual harassment at the workplace in the complaint.
Manjunath has been general manager at the Herald Publications Pvt Ltd for some years now. That virtually puts him charge of the daily operations of Goa’s second ‘largest circulated English daily’ and the Herald Cable Network.
Before his latest claim to glory as an alleged sexual aggressor, Manjunath has another claim to fame -- other than several of those, which involve him pandering to managing director Raul Fernandes’ Mohammad bin Tughlaq like whims.
Manjunath, along with MD’s personal assistant Michael were responsible for the elaborate OPERATION COAX AND BULL.
This was the dramatic exercise, which was launched by the Herald management to stop the exodus of Herald journos into the Times of India. The extent of the zeal with which Manjunath carried out this job can be judged from a text message he sent to a former Herald journo, who was Christian by faith.
While imploring his target not to quit the Herald, this is an excerpt from the evangelist-cum-marketing pitch Manjunath made to the journo. 'Dear ……. Herald is your paper. ‘Herald is a newspaper of the Christians, for the Christians, by the Christians’, so why are you quitting it for some other paper?

Coming back to this case… First of all Penpricks commends the victim for the rare nerve she has shown in bringing this issue out into the open. We hope that at least some of her colleagues will stand by her, in these difficult times.
The victim (we’ll call her X) who has simultaneously submitted her resignation, along with her complaint was employed as a production assistant at HCN since February 2008. After a few months she was suddenly transferred to the reception desk.
Inexplicable… how can a person hired for TV production duties be shifted to the reception? But stranger things have happened in the Herald
The transfer order was issued in June 2008, by the Human Resource department under orders from Michael Pereira, the complaint states. She was told that the arrangement would exist only for 3 to 4 days, but carried on till day she put in her papers.
But there appears to be a design behind her transfer to the reception, because the reception desk is from where the sexual harassment trail starts.
The letter claims that soon after the transfer, the general manager Manjunath allegedly started making passes at her. He would make X leave her desk and sit in his cabin, from where she was made to line up all the calls.
“This led to him coming on to me, whenever Mr Michael was not present in the office. During the last few days I had a very bad feeling since Mr Manjunath started asking if the doors were locked whenever he summoned to his office,” the complaint states.
X claims that Manjunath then started insisting that he pick her up and drop her home to and from work.
But it was Manjunath alleged recent actions, which proved to be the proverbial last straw. “He started taking advantage of me by touching my face, caressing my hand and head, whenever I focused on something. I told him a couple of times to keep his hands off me and that I do not like being touched, but he persisted,” X claims in her complaint.
Something needs to be done about this guys.
The allegations made by the victim need to be probed. We are not saying ‘lynch Manjunath’ right away. But this issue needs an honest looking-into, because a similar incident involving a senior editorial staffer in the HCN was hushed up by the management.
Raul needs waking up guys… And it’s you guys who can do it. Do not rely on Herald staffers to do it.
Perhaps if the earlier sexual harassment instance had been adequately handled by the Herald management or even the journo community at large, a repeat could have been avoided.
Please call up Raul on this phone number and tell him to initiate an impartial enquiry into the incident. Please call him even if you don’t know him. Let him know that such incidents should not be hushed up.
There are times when Raul acts like a deaf bull in a hearing-aid store.
So guys please call him. Keep calling
him whether you are in Goa or not... until he initiates and takes this complaint to its logical conclusion.
There are a few more numbers we are leaving behind here.
You guys could also call up Herald Editor Ashwin Tombat on his direct line and ask him to ensure a fair and impartial enquiry into the affair. Or you could call up the National Commission for Women and ask them to take the case seriously.

This ........... is a horrible person. It is learnt that Police from Karnataka came to arrest him in connection with some non payment matter. He has ruined BIG BOX of Verna, a sister concern of Herald in his 3 years of service and now he is runing the HERALD. Mr. Raul Fernandes, plese wake up. This is the time to take tough decision to save HERALD from the clutches of .......... and his partner M............. Please think about future of your Herald staffs who are solely depend upon their job and save the Herald by kicking out these two blood suckers naely M......... and M............. Maybe the fact that even some sincere journos and clued in readers read this blog occasionally, even if only for sheer amusement- has gone to the head of you Penpricks, coz this is truly a case where u'r pr***s are mightier than u'r pens. I have no sympathy for anyone in this whole issue but maybe alittle bit more research into this Madame'X's background would have helped. While she has my full support in case the ALLEGED touchy-feely episodes happenned, as regards her job, well all she did for HCN was to act as Angela Calina's stand in shopping aide. And when not in line of duty, she used to loiter outside in corriders on endless personal phonecalls on her mobile. It was only after some hardworking employees got disgruntled with this royal job profile of hers and started murmuring their dissent that she was assigned a PROPER portfolio at the reception. maybe the ladidah lady found making OFFICIAL phone calls too much of a chore and maybe was just looking for an escape route when someone brainwashed her. As regards, the cabin door being locked, the touching etc...may the truth prevail but all I'm tryting to point out is that u penpricks have turned your blog into nothing but a sensationalised version of an underground e-paper just looking to make splash with every new post. God knows who supplies you with these half baked stories and u end up questionig credibility of papers while losing your own in the process. Maybe someone needs to start a blog on penpricks- maybe call it Penpricks and their dirty Tricks! Tch!Tch!

Laws and Procedures: Sexual Harassment in the Workplace
Vishaka Guidelines against Sexual Harassment in the Workplace

Guidelines and norms laid down by the Hon’ble Supreme Court in Vishaka and Others Vs. State of Rajasthan and Others (JT 1997 (7) SC 384)

HAVING REGARD to the definition of ‘human rights’ in Section 2 (d) of the Protection of Human Rights Act, 1993,

TAKING NOTE of the fact that the present civil and penal laws in India do not adequately provide for specific protection of women from sexual harassment in work places and that enactment of such legislation will take considerable time,

It is necessary and expedient for employers in work places as well as other responsible persons or institutions to observe certain guidelines to ensure the prevention of sexual harassment of women.

1. Duty of the Employer or other responsible persons in work places and other institutions: It shall be the duty of the employer or other responsible persons in work places or other institutions to prevent or deter the commission of acts of sexual harassment and to provide the procedures for the resolution, settlement or prosecution of acts, of sexual harassment by taking all steps required.

2. Definition: For this purpose, sexual harassment includes such unwelcome sexually determined behaviour (whether directly or by implication) as:

a) Physical contact and advances;

b) A demand or request for sexual favours;

c) Sexually coloured remarks;

d) Showing pornography;

e) Any other unwelcome physical, verbal or non-verbal conduct of sexual nature

Where any of these acts is committed in circumstances where-under the victim of such conduct has a reasonable apprehension that in relation to the victim’s employment or work whether she is drawing salary, or honorarium or voluntary, whether in government, public or private enterprise such conduct can be humiliating and may constitute a health and safety problem. It is discriminatory for instance when the woman has reasonable grounds to believe that her objection would disadvantage her in connection with her employment or work including recruiting or promotion or when it creates a hostile work environment. Adverse consequences might be visited if the victim does not consent to the conduct in question or raises any objection thereto.

3. Preventive Steps: All employers or persons in charge of work place whether in public or private sector should take appropriate steps to prevent sexual harassment. Without prejudice to the generality of this obligation they should take the following steps:

(a) Express prohibition of sexual harassment as defined above at the work place should be notified, published and circulated in appropriate ways.

(b) The Rules/Regulations of Government and Public Sector bodies relating to conduct and discipline should include rules/regulations prohibiting sexual harassment and provide for appropriate penalties in such rules against the offender

(c) As regards private employers, steps should be taken to include the aforesaid prohibitions in the standing orders under the Industrial Employment (Standing Orders) Act, 1946.

(d) Appropriate work conditions should be provided in respect of work, leisure, health and hygiene to further ensure that there is no hostile environment towards women at work places and no employee woman should have reasonable grounds to believe that she is disadvantaged in connection with her employment.

4. Criminal Proceedings: Where such conduct amounts to a specific offence under the Indian Penal Code or under any other law, the employer shall initiate appropriate action in accordance with law by making a complaint with the appropriate authority.

In particular, it should ensure that victims, or witnesses are not victimized or discriminated against while dealing with complaints of sexual harassment. The victims of sexual harassment should have the option to seek transfer of the perpetrator or their own transfer.

5. Disciplinary Action: Where such conduct amounts to misconduct in employment as defined by the relevant service rules, appropriate disciplinary action should be initiated by the employer in accordance with those rules.

6. Complaint Mechanism: Whether or not such conduct constitutes an offence under law or a breach of the service rules, an appropriate complaint mechanism should be created in the employer’s organisation for redress of the complaint made by the victim. Such complaint mechanism should ensure time bound treatment of complaints.

7. Complaints Committee: The complaint mechanism, referred to in (6) above, should be adequate to provide, where necessary, a Complaints Committee, a special counsellor or other support service, including the maintenance of confidentiality.

The Complaints Committee should be headed by a woman and not less than half of its member should be women. Further, to prevent the possibility of any undue pressure or influence from senior levels, such Complaints Committee should involve a third party, either NGO or other body who is familiar with the issue of sexual harassment.

The Complaints Committee must make an annual report to the Government department concerned of the complaints and action taken by them.

The employers and person in charge will also report on the compliance with the aforesaid guidelines including on the reports of the Complaints Committee to the Government department.

8. Worker’s Initiative: Employees should be allowed to raise issues of sexual harassment at a workers’ meeting and in other appropriate forum and it should be affirmatively discussed in Employer-Employee Meetings.

9. Awareness: Awareness of the rights of female employees in this regard should be created in particular by prominently notifying the guidelines (and appropriate legislation when enacted on the subject) in a suitable manner.

10. Third Party Harassment: Where sexual harassment occurs as a result of an act or omission by any third party or outsider, the employer and person in charge will take all steps necessary and reasonable to assist the affected person in terms of support and preventive action.

11. The Central/State Governments are requested to consider adopting suitable measures including legislation to ensure that the guidelines laid down by this order are also observed by the employers in Private Sector.

12. These guidelines will not prejudice any rights available under the Protection of Human Rights Act, 1993.

Other legal provisions include filing a criminal case under sections of the Indian Penal Code (IPC), the Indecent Representation of Women (Prohibition) Act and/or filing a civil suit.

The sections of the Indian Penal Code that can be applicable to sexual harassment (which makes it a criminal case):

1. Section 294
‘Whoever, to the annoyance of others, (a) does any obscene act in any public place, or (b) sings, recites and utters any obscene songs, ballads or words, in or near any public space, shall be punished with imprisonment of either description for a term that may extend to three months, or with fine, or with both.’ This provision is included in Chapter XVI entitled ‘Of Offences Affecting Public Health, Safety, Convenience and Morals’ and is cognisable, bailable and triable by any magistrate.

2. Section 354
Whoever assaults or uses criminal force on any woman, intending to outrage her modesty or knowing it likely that he will thereby outrage her modesty, shall be punished with imprisonment for a term which may extend to two years, or with fine, or with both.

3. Section 509 (Word, gesture or act intended to insult the modesty of a woman) This is included in Chapter 22 entitled ‘Of Criminal Intimidation, Insult and Annoyance’, and is cognisable, bailable and triable by any magistrate. It holds: ‘Whoever, intending to insult the modesty of a woman, utters any word, makes any sound or gesture, or exhibits any object, intending that such word or sound shall be heard, or that such gesture is seen by such woman, or intrudes upon the privacy of such woman, shall be punished with simple imprisonment for a term which may extend to one year, or with fine, or with both.’

Under the Indecent Representation of Women (Prohibition) Act (1987) if an individual harasses another with books, photographs, paintings, films, pamphlets, packages, etc. containing the “indecent representation of women”, they are liable for a minimum sentence of 2 years. Section 7 (Offenses by Companies) further holds companies where there has been “indecent representation of women” (such as the display of pornography) on the premises, guilty of offenses under this act, with a minimum sentence of 2 years.

Civil case: A civil suit can be filed for damages under tort laws. That is, the basis for filing the case would be mental anguish, physical harassment, loss of income and employment caused by the sexual harassment.

For the record: The senior news producer at HCN who was accused of sexual harassment late last year (2007) did not get off scot-free. He was handed his walking papers, after his response to an official inquiry into the matter contained words like "whore" in referring to the complainant.

Predatory sexual behavior, specially against women, was never tolerated at HCN, at least from November 2007 to April 2008.

As for the fellow who called the recent complainant a "crow", imagine this "crow" is your sister or your mother. She was brave enough to complain that she felt violated. She may not look like Aishwarya Rai, and let's assume you are correct in saying this girl has a "past history" (sic, as if history can be in the present or future), does that make her fair game for sexual advances?

You are absolutely right. Facts have to be ascertained before anybody should comment. We should just practice what we preach.

After the so-called coup - the PP "super prank" I have stopped really reading your blog. Because I think you guys are yellow "bleep bleep bleeps" who don't have the guts to face the world. The other thing that made me stop loking at this blog was the fact that you guys literally thought you had done something super with your silly prank. As it is there are enough hoaxes on the Net without you so-called "responsible" "bleep"-holes adding on to the junk.

Anyway, the purpose of this comment is to make you aware, because I am sure you aren't, that the small band of ex-Goa News employees who banded together and lodged an industrial dispute with the Labour Commissioner have reached a settlement with the management who are paying them compensation.

But I guess this is not important - that the small guys win. All that matters to you pricks is a "super prank" and interviewing pricks like Ajay Thakur, who thought he was big boss at Goa News, but was nothing but a snotty prick who needed prick like you to wash his shitty ass.

I dare you to publish this comment.

I also dare you to look to an investigative piece on Goa News and see why it closed down and how much of the closing down was due to the prick Ajay Thakur.

I dare you to interview some of the sincere employees of Goa News who lost out due to the silly antics of people like Gokul Kumar, Mani and Ajay Thakur. I dare you to find out how the three names mentioned in the previous sentence literally raped and milked Goa News and J. K. Jain.

Looks like the Indian citizen who has commented is definately a migrant or coming from a slum area who carries a cheap mentality going by the looks of a person ,I would suggest this person commenting to cross check Mr M's (edited) past history before joining herald panjim office that why did most of the female staffers leave their jobs in BIG BOX Verna ( A sister concern of Herald )a s...... like Mr M (edited) will never see if its a crow or what while god has not created & not he differently coloured it,its natures colour what evryone has got .May be the guy who has comments he has a wife with crowish complexion or may be luking like a whore but then its again the nature. Maybe the guy who commented is also the other South Indian who works in the Herald, who looks more like a crow suffering from diahrrea, constipation and small pox alltogether... Maybe this crow flies from Guirim to Panjim everyday to nest in the Herald...

I AGREE as my remarks about Niseer's role have been purposely struck out.
It looks to me like this blog wants REVENGE on its MORTAL enmies who are former Herald employees . Thus, want to settle scores with them who are in their bad books.
Also though the so-called anonymous PRICKS can dish it they cannot stomach any criticism against them is proved by the comments deliberately left out in support of their mortal enmies.
Et Tu PP? Please clarify the reason to attack Nisser when Mr M is involved in the alleged case.

Given the way Arun Sinha has got away with almost r....; given the Vaman Naik has yet to be punished and continues to pull in a salary of 50,000 a month of public money; my bet is nothing will come of this matter. If this had happened in Delhi, a horde of women's organizations would have descended upon the offenders. Here in Goa I call these organizations Bailanche Paad.

Before starting my comment let me clarify that:
1. I am not in the habit of posting comments on this blog unless it concerns me.
2. I rarely read this blog let alone post comments.
3. This particular comment was pointed out to me by a colleague on August 17 -- hence, the delay.

Now my comments:

1. I did not post the first comment so obviously the second comment is totally unwarranted, as it is clearly aimed at me.

2. I haven’t even seen the girl in question let alone comment on her.

3. The person who posted the comment exhibits xenophobic character.

I am not a Goa journo, nor have I known the lady in question. But as a journo who has travelled to Goa off and on to do stories, the issues taken up by penpricks have interested me enough to follow the blog (notwithstanding the proofing errors that are so typical of your blog). I have been following the comments made on the latest incident of sexual harassment here, and I just cannot help remarking on some opinions expressed. As a woman and someone who knows enough about the way sexual harassment occurs at the workplace, I would say: women never seem to win. If a female is bad to look at, she is referred to as a crow whom no one would possibly want to do something to. If she is pretty, everyone says: she should not have gone to work in the first place.
Or else..how can you blame the guy? it was but natural for him to make a pass. If she dresses provocatively..she had to expect it. If not...no guy in his right senses could even give her a second look!

In the bargain, any guy can get away scot-free..because nothing can be proved.In short..females face a double-edged sword. BTW, why does no one say anything about the looks of a man ever?

I would have to agree that the woman posting comments here repeatedly in "CAPS" is posting a lot of meaningless crap. Her language sucks, and thats an understatement. No offense lady, why don't you just post 1 single comment that makes sufficient sense instead of posting 100's timed within a span of 2-3 minutes. That should make your comment more readable. You could use the time that you save by doing the above to go improve on your spellings and grammar (I do honestly hope that you are not part of the team that posts active content on the newspaper and work as a support function like accounts etc..) Oh and do stop posting your comments in "CAPS" its downright irritating and ethically demeaning.... go figure!
